SUMMARY OF ORDINANCE NO. 007/2008
On February 26, 2008 the City Council of the City of Monroe, Washington, approved Ordinance No. 007/2008, the main point of which may be summarized by its title as follows:
AN ORDINANCE OF THE CITY OF MONROE, WASHINGTON, AMENDING SUBSECTION A OF MMC 13.04.026 AND SUBSECTION A OF MMC 13.08.275 IN ORDER TO EXEMPT TRANSITIONAL HOMES FOR THE HOMELESS OPERATED BY GOVERNMENT ORGANIZATIONS FROM WATER SYSTEM CAPITAL IMPROVEMENT AND SEWER TREATMENT FACILITY RESERVE CAPACITY CHARGES; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE.

NOTICE OF SEPA DETERMINATION
NOTICE is hereby given that a DETERMINATION OF NON-SIGNIFICANCE (SEPA200805) has been made by the City of Monroe Community Development Director for Zoning Code Amendment ZCA200801 (Airport compatibility).
These proposed amendments to Monroe Municipal Code Chapter 18.60 (Airport Compatibility) will remove the land use restrictions in Zone 6A (Traffic Pattern); increase the maximum density for non-residential uses in Zones 3 (Inner Turning Zone), 4 (Outer Turning Zone), and 5 (Sideline Zone); remove the requirement for an avigation easement; and minor edits to the chapter format.
Comments and appeals to the SEPA determination must be submitted by 5:00 p.m., Wednesday, March 19, 2008 to Monroe City Hall, 806 West Main Street, Monroe, WA 98272. Appeals must be filed in person to the City Clerk on forms available at City Hall and must be accompanied by a filing fee set in the Fees Resolution in place at the time the appeal is filed. Fax, mail, or e-mail appeals will not be accepted.

NOTICE OF PLANNING COMMISSION PUBLIC HEARING
NOTICE is hereby given that a PUBLIC HEARING will be held for Comprehensive Plan Amendment (CPA2008D) and associated amendment to the Monroe Municipal Code Chapter 13.08 (Sewer system regulations) on Monday, March 24, 2008 at 7:00 p.m. by the City of Monroe Planning Commission in the Council Chambers at City Hall, 806 West Main Street, Monroe, Washington.
These proposed emergency amendments reaffirm that the city's sewer service area is the City of Monroe corporate limits and removes existing provisions that allow the City Council to extend sewer service outside the city limits when a proposed development complies with City of Monroe development standards and the applicant pays all Monroe's adopted impact fees. The proposed amendments are in response to a recent decision by the WA State Court of Appeals decision in MT Development v. City of Renton, which prohibits a city from applying its zoning and development standards on a development when the development is located in another jurisdiction, i.e. an unincorporated portion of a city's urban growth area. These proposed amendments will specifically amend an annexation policy in the Land Use Element of the Monroe Comprehensive Plan, Land Use Policy LUP 6.5, and Monroe Municipal Code Section 13.08.240 (Sanitary sewer service outside the city limits).

Project description: The applicant filed an application to subdivide three (3) existing lots equaling 1.7 acres into nine (9) residential lots, including four (4) single-family lots and five (5) duplex lots.The properties are in the UR6000 zoning district. Concurrently, the applicant requested a modification of lot design standards, related to the maximum length and area of access easements, to enable the construction of a private road. The proposal will result in the creation of 14 potential dwelling units, with an estimated 140 average daily trips. City sewer and water services will be provided to the proposed lots. A Mitigated Determination of Non-Significance was issued January 29, 2008 (re-issued February 12, 2008).
Approval: Staff administratively reviewed the project for compliance with the policies, standards, and regulations of the City of Monroe. The short subdivision is APPROVED based on the Findings of Fact and Conclusions and shall be subject to Conditions of Approval.
The decision is considered issued on March 4, 2008 (the day the decision was mailed to all parties of record).
NOTICE OF RIGHT OF APPEAL: Parties of Record may file an appeal of this decision within fifteen (15) working days from issuance of this Notice of Decision in conformance with MMC 17.32.070. Appeals must be submitted to the City of Monroe by Tuesday, MARCH 25, 2008. Appeals shall be in writing and accompanied by an appeal fee as outlined in the city's most current fee resolution.
